1. Data Controller.

The data controller of your personal data collected through the online store, i.e., the operator that decides how to use them, is the company MNK Group, located in Lublin, at 41/2 Fryderyka Chopina Street, mailing address: 41/2 Fryderyka Chopina Street, 20-023 Lublin, NIP: 7123371252, REGON: 380402511. MNK Group Sp. Z O.O.

The data controller also serves as a service provider for the online store and seller, available at www.maxi.parts. The data controller pays special attention to protecting the interests of natural persons, in particular, being responsible for their secure use in accordance with the contract and applicable rules.

2. Purpose and legal basis for processing personal data.

We process your personal data that we received from you when creating an account and during cooperation, as it is necessary for:

2.1. concluding and performing the contract for the provision of electronic services (which allows you to make full use of our online store, including accepting and managing your account, maintaining your account and transactions conducted through it, processing your requests sent through the contact form, and contacting you for the purpose of providing services)

2.2. entering into and performing sales contracts (that includes, contacts for purposes related to order fulfilment, shipment of goods, and complaints)

2.3. fulfilment of legal obligations binding on us (including, tax and accounting obligations, such as invoicing)

2.4. realisation of our legitimate interests, namely:

2.4.1. conducting marketing activities, including direct marketing;

2.4.2. determining the interests of people who use the online store by monitoring search keywords in order to tailor our store offer to your needs;

2.4.3. to establish, defend and resolve claims (including debt collection and litigation). With your consent, we will process your personal data for the purpose of storing data in cookies. You can withdraw your consent at any time. Withdrawal of consent does not affect processing operations performed by us, on the basis of consent prior to its withdrawal.

3. Personal data required by us

In order to conclude and fulfil a contract for the provision of electronic services (using the online shop), as well as to conclude and fulfil sales contracts, we require you to provide the following personal data: e-mail address, contact telephone number, company information (including company name, registered office address) , delivery address, if different from the registered office address, NIP, REGON).

Failure to provide the above data does not allow us to conclude a contract with you, which deprives you of the opportunity to use our online shop and place orders. Refusal to provide data other than the above mentioned does not affect the possibility to conclude and fulfil the contract.

4. Your rights in relation to data processing

In relation to our processing of your personal data, you can make a request to us for:

4.1. rectification of your data - where it is incorrect or incomplete

4.2. erasure of the data - in the following cases:

4.2.1. when the data is no longer necessary for the purposes for which it was collected by us,

4.2.2. you withdraw your consent for us to process your data,

4.2.3. you raise an objection to our processing of your data,

4.2.4. your data is unlawfully processed by us,

4.2.5. the data needs to be erased in order for the Administrator to comply with a legal obligation or the data was collected in connection with the provision of an electronic service to a child

4.3. restriction of data processing - in the following cases:

4.3.1. when you dispute the accuracy of your personal data - for a period of time to allow us to check the accuracy of the data,

4.3.2. when your data is unlawfully processed, but you do not want it to be deleted,

4.3.3. when your data is no longer needed by the Administrator, but may be needed by you to defend or assert claims,

4.3.4. you raise an objection to our processing of your data - until such time as it is determined whether the legitimate grounds on our side override the grounds for the objection

4.4. access to your data (to request information about the data we process and to request a copy of your data)

4.5. data portability to another administrator or to you - in the following cases:

4.5.1. when data processing is based on your consent or on the basis of a contract concluded between us,

4.5.2. where the processing of your data is carried out by automated means.

5. Right to object

Not withstanding the rights set out in paragraph 4, you have the right to object to our processing of your data in the following cases:

5.1. for reasons related to your particular situation, where the processing of your personal data is carried out on the basis of a legitimate interest of the Controller or for statistical purposes

5.2. your personal data is processed for direct marketing purposes, including profiling. In order to lodge an objection or exercise the right referred to in point 4 of this privacy policy, you may contact us by submitting a request via email to info@mnk.group.pl.

6. Complaint

If you consider that our processing of your personal data violates the law, you have the right to lodge a complaint with the President of the Office for Personal Data Protection.

7. Data sharing

We share your data with:

7.1. entities operating our ICT system or providing us with ICT tools,

7.2. organisations providing us with software,

7.3. with persons who service payment in our online shop,

7.4. with persons who provide us with auditing, legal, tax, financial, accounting and bookkeeping services,

7.5. with persons who carry out courier services,

7.6. with public authorities at their reasonable request.

8. Personal data retention period

Personal data collected by us:

8.1. for the purpose of concluding and performing a contract - we store it for the duration of the contract and post-contractual settlements (including the time of possible claims or defence of rights),

8.2. to fulfil our legal obligations - we store it for the period prescribed by law,

8.3. for the purpose of pursuing our legitimate interests - for the duration of the legitimate interest (including for marketing purposes - for the duration of the contract or until you object to the processing of your data for this purpose).

9. Automatic processing of personal data

Your data will not be processed by automated means (including profiling).

10 Cookies

When you visit our website and use the online shop, cookies are stored on your end device (computer, smartphone, tablet, etc.). The maxi.parts website uses 2 types of cookies: session cookies and persistent cookies. Session cookies (temporary files) are stored on your device until you leave our website or close your browser. Persistent files are stored on your device for the time specified in the parameters of these files or until they are deleted. The cookies we use are

10.1. basic (necessary) - these files ensure the proper functioning of the online store, entering the store, navigating the store, making purchases. Their storage is necessary for the use of the online store,

10.3. statistical files - allow us to collect statistical information about how the store is used,

10.4. files that ensure the security of transactions made in our online store. 11 Safety rules

Please remember to:

11.1. set up your login and password to access your account in such a way that they cannot be easily guessed by third parties (recommended sequence of at least 8 characters and digits, upper and lower case letters and a special character),

11.2. to log off from the website www.maxi.parts each time after the session ends,

11.3. to keep the login and password in secret,

11.4. use of anti-virus software, including regular scanning of disks for viruses,

11.5. to use the website and the online shop only on trusted computers on which only tested software is installed.

12. Rules for deleting your account in the online shop

You can request the deletion of your account at any time by sending an e-mail to info@maxi.parts. The account will be deleted immediately upon receipt of the request, but not before the orders assigned to it have been completed. The restoration of such an account is not possible. In such a situation, making another purchase in the online shop requires providing personal data again, which is necessary to complete the order.

This privacy policy is effective as of 25 May 2018.

Due to continuous development and advances in technology, the rules set out in this document are subject to change. You will be informed of changes to these rules on time, no later than 7 days prior to their implementation, by posting the new content of this document on the website www.maxi.parts.
